Architects Registration Board’s Duties and Powers (14/07/2003)

For some time it has been asserted that the Architects Registration Board has over a lengthy period exceeded its powers and gone beyond the duties given to it under the Architects Act 1997. It has been suggested that the Board misunderstood the nature of the Act or knowingly asserted powers that the Board did not possess. Given the far ranging charges made against it, the Board decided at its meeting on 20 May 2003 that the only course open to it was to obtain the opinion of Counsel on all of the allegations made and to consider any issues arising at a further special meeting. Mr Timothy Dutton QC was asked to consider all the matters raised. His advice has now been received.

Counsel’s advice is that the Board has acted within its powers in respect of all of the matters where the contrary had been asserted. Since the advice raises no substantive issues requiring consideration at a special meeting, the Board will now consider it and any matters arising, at its next meeting on 25 September.
