PCC orders erasures from the Register (11/04/2005)
At a Hearing of the Architects Registration Board’s Professional Conduct Committee in London on 7 April 2005, four architects were erased from the Register. They had been found guilty of unacceptable professional conduct in relation to their failure to hold Professional Indemnity Insurance.
Clifford Gardner of Putney, John Simms of Banbury, Brian Cooper of Reigate and Robert Kirk of County Antrim had been advised at a PCC Hearing on 15 March 2005 that the Committee was of a mind to impose a penalty order of erasure. The matters were adjourned to give the architects the opportunity to mitigate.
Mr Gardner attended the hearing and submitted mitigation on his own behalf. The other defendants did not attend the hearing.
In summing up the matter of Mr Gardner, the Chair of the Committee said that :
“We have given careful consideration to the suggestion that suspension would be a more appropriate penalty, but we have come to the conclusion that in these circumstances, it is not an appropriate penalty. Suspension is limited in its extent, and we do not consider that it reflects the seriousness of the offence.”
