CHARGE

The charge is that the architect is guilty of unacceptable professional conduct, individually or cumulatively, in relation to the following facts, and that is pursuant to Section 14(1)(a) and 14(1)(iii) of the Architect’s Act 1997.  The allegations of fact to support the charge are:

(i) That he failed to maintain adequate and appropriate professional indemnity insurance from 7 June 2007 in accordance with Standard 8(1) of the Architect’s Code, Standards of Conduct and Practice 2002 (‘the Code’).

(ii) That the failed to provide evidence of professional indemnity insurance in the form required by the Board in order to demonstrate compliance with Standard 8(3) of the Code and as requested by the Board in letters dated 7 June 2007 and 21 September 2007.

(iii) That he failed to provide a substantive reply or to procure a substantive reply to correspondence from the Board dated 7 June, 21 September and 29 October, all 2007, promptly and within the timescale set out in Standard 12(4) of the Code. 

DECISION

THE CHAIR: The Committee gave careful consideration to the papers and evidence presented by the Board’s solicitor, John Williams, and the submissions made by him.  The Committee finds David James Hutchison guilty of unacceptable professional conduct in relation to charge 2(2) and 2(3).
Before we consider the penalty, is there anything you want to tell us about Mr. Hutchison?

MR WILLIAMS:  No, Madam.  He has no previous disciplinary matters.

THE CHAIR:  Looking at the evidence, Mr. Hutchison was notified many times, and he signed for the papers himself personally on 14 April 2008.  He has chosen not to offer any explanation to the Registration Board.  This is totally unacceptable.  Registrants must reply to their Registration Board if they want to remain registered.  Therefore, it is erasure.
