DECISION

THE CHAIRMAN: In the case of Mr Kirk, I should again re-emphasise that we had already made a finding of guilt.

It is perhaps worth, in the light of what Mr Kirk has said in his letters, just making two points. First of all, the finding of unacceptable professional conduct was based on the particulars set out by the Solicitor Complainant, which of course also included a failure to reply to correspondence and a failure to supply and produce relevant information and documentation. In particular, we note that there was a failure to reply to Simon Howard 's letter of the 11th December 2003 , asking Mr Kirk for details of his practice.

Mr Kirk did write a letter on 27th February 2004 which set out details of his practice and from which it is clear that he had practised as an architect without insurance.

We see nothing in the correspondence to make us change our mind about our original finding of guilt. There has been nothing in Mr Kirk's letters which suggests to us that erasure is not suitable.

I should just make the point that it has been confirmed to us this morning that Mr Kirk's name is still on the register.

In this case we also make an order that Mr Kirk's name be erased from the register.
